According to an Originating Summons filed in the Grand Court on February 29, 2024, orders are being sought to modify a 15ft vehicular Right of Way along the northern boundary of Block 106C parcel 78 and 79 located in the Registration Section Cayman Brac East. The application was filed on behalf of the Governor of the Cayman Islands against the Registrar Of Lands and the Public Lands Commission.
Based on the Summons, the grounds of the application are as follows:
1. The 15th vehicular right of way over Block 106C parcels 78 and 79 are in favour of Block 106C parcel 46.
2. The Plaintiff owns the properties located at Block 106C parcel 78, Block 106C parcel 79, and Block 106C parcel 46.
3. The lands at Block 106C parcels 46, 78, and 79 are contained within the Creek Primary School, Cayman Brac; therefore, the continued existence of the vehicular right of way impedes the reasonable use of the lands as a public school.
4. The Public Lands Commission supports a modification of the existing public right of way.
It is understood that this matter will be heard before a judge in Chambers.
