Property owners sue tenants for 13k in rent, strata and garbage fees Loop Cayman Islands

Owners of an apartment in West Bay have filed a claim in Grand Court (stamped on March 20, 2023), alleging that their tenants owe approximately CI$13,011.13 arrears of rent, strata, insurance, garbage fees, and mesne profits. In addition to requesting that this amount be paid, the owners are asking the Grand Court for an order for possession of the property.

According to the claim, the tenants entered a lease-to-purchase agreement made on or about November 1, 2015, which required them to pay a monthly rent of CI$700, strata fees of CI$125 per month, and a garbage fee of CI$250. Further, the tenants were responsible for payment to the strata corporation for insuring the unit.

The tenants allegedly breached the terms of the lease-to-purchase agreement by allegedly failing or refusing to pay the foregoing fees.

Based on the claim, the tenants were subsequently given notice of the alleged breach, and the lease-to-purchase agreement was terminated.

The owners subsequently filed the claim in Grand Court saying: “As of 17 March 2023, the Defendants’ arrears pursuant to the Agreement, combined with mesne profits from the date of termination of the Agreement to 17 March 2023 are approximately CI$9,100 in respect of rent; and CI$3,911.13 in respect of strata, insurance, and garbage fees.”

The claim continued: “The Defendants remain in possession of the Property as trespassers.”

The owners now want the Grand Court to issue an order to return the property to the owners and want all alleged outstanding fees to be paid.
