Driver Sued For Negligence After Shamrock Road Accident

According to a Writ of Summons stamped by the Grand Court on June 14, 2024, the driver of a Ford Fiesta is suing the uninsured driver of a Toyota Rav4 for an unspecified amount of general and special damages. The Ford Fiesta driver alleged that the damages relate to an accident caused by the negligence of the Toyota Rav4 driver.

Based on the Writ, on April 14, 2023, the Ford Fiesta driver was proceeding along Shamrock Road approaching the Grand Harbour roundabout.  On approaching the roundabout at Grand Harbour, the Ford Fiesta driver came to a stop when the Toyota Rav4 driver allegedly collided with the rear of the Ford Fiesta.

Reportedly, the Ford Fiesta driver “was transferred to George Town Hospital by ambulance complaining of tenderness to her right ankle and pain to the back of her head.”

The Writ added:

She attended her General Practitioner following the accident complaining of neck and shoulder pain.

She was prescribed medication.

She was referred for physiotherapy and underwent a course of physiotherapy.

Explaining alleged losses beyond her injuries, the Writ said she “suffered loss and incurred expenses as a result of the accident” and damages include “but not limited to claims for loss of income, medical treatment, travel, equipment and gratuitous care.”

The Writ further alleged that the Toyota Rav4 was negligent because the driver “failed to keep any or any proper look out, failed to see the Plaintiff’s vehicle whether in time or at all, failed to apply his brakes whether in time or at all and failed to steer or control his vehicle so as to avoid the said collision.”

In addition to general and special damages for the above, the Ford Fiesta driver is seeking costs and such further or other relief that the Court deems just.
